Suttles hit with multiple charges after alleged incident at Lottie’s

A Marion man has been charged in connection with an early-morning incident at Lottie’s Restaurant on Washington Street that left the popular eatery’s owner and another person injured.

Charges Filed

According to a criminal complaint filed in Perry County District Court, Lue David Suttle of Marion was arrested Jan. 23 and charged with:

  • One count of second-degree burglary
  • Two counts of second-degree assault
  • One count of making a terrorist threat in the second degree
  • One count of reckless endangerment

Details of the Alleged Incident

Court records state that around 6:20 a.m. on Jan. 22, Suttle allegedly entered the building of Lottie’s Restaurant “with intent to commit a theft or felony.” While in the building or in immediate flight from it, he allegedly used or threatened the immediate use of a deadly weapon or dangerous instrument.

The complaint alleges that during the incident, he caused physical injury to the restaurant’s owner, Byron Turner, who is described in the filing as “not a participant in the crime.”

Assault Allegations

In addition to the burglary charge, Suttle is accused of striking Turner in the face with a shotgun, causing what the complaint describes as serious physical injury.

He is also charged with second-degree assault for allegedly striking Tawana Heard in the face with a shotgun during the same incident.

Terrorist Threat and Reckless Endangerment Charges

The making a terrorist threat charge stems from allegations that Suttle, “based on an objective evaluation,” credibly threatened to commit a crime of violence against another person or property by use of a deadly weapon, specifically a shotgun, according to the complaint.

The reckless endangerment charge alleges that he used a deadly weapon and made threats in a public place, creating a substantial risk of serious physical injury to Turner.

Bond and Case Status

Bond in the case has been set at $71,000, according to court records. Suttle was listed in jail status following his arrest.

The charges outlined in the complaint are accusations at this stage of the proceedings. Suttle is presumed innocent unless and until he is found guilty in court.
