Woman sues Perry County for damages after 2023 car crash

A Perry County woman has sued the Perry County Commission, a county employee and Alfa Mutual Insurance Company over a November 2023 crash in downtown Marion, alleging she was stopped at a red light when she says a county-owned vehicle hit her from behind.

In a complaint filed Sept. 29 in Perry County Circuit Court, plaintiff Lucy E. Moore claims a county employee was driving a county-owned vehicle “in the line and scope” of his job on Nov. 2, 2023, when he failed to stop at the intersection of Washington Street and E. Lafayette Street and struck Moore’s car. She says she previously notified the county of her claim on Dec. 7, 2023. Moore alleges negligence and wantonness against the employee, and seeks to hold the Perry County Commission liable under respondeat superior. She also brings claims of negligent and wanton entrustment, hiring, supervision, monitoring and training against the county. The filing says Moore suffered injuries to her neck, back, right hip, shoulder and head, along with lost wages and medical expenses. She asks for compensatory and punitive damages and a jury trial.

The complaint further names ALFA Mutual Insurance Company, asserting Moore carried an auto policy that provides uninsured/ underinsured-motoris t benefits and that any liability coverage available to the county and driver is insufficient to cover her losses.

The commission, employee, and ALFA have not yet filed responses. Allegations in a civil complaint represent one side of a case and must be proven in court.
