Hearing set for today in lawsuit between Sheriff, Chairman

A hearing in Sheriff Roy Fikes’s lawsuit against County Commission Chairman Albert Turner Jr. and Perry County is set for today, Thursday, Sept. 25, 2025.

Fikes filed the civil action seeking declaratory and injunctive relief over who controls courthouse security, discipline of security personnel, and access to the courthouse. The complaint alleges Turner exceeded his authority by attempting to discipline members of the sheriff’s courthouse security staff, directing payroll to stop paying those employees, changing locks at the courthouse and refusing to provide passkeys to the sheriff and his officers, and by imposing rules on cell phones and firearms in and around courtrooms.

Fikes asks the court to declare that the commission lacks legal authority to withhold keys, reject the sheriff’s payroll submissions, or discipline his personnel; to require that keys and access be restored to the sheriff and his officers; and to enjoin further interference while the case proceeds.

Judge Wiggins has not ruled on Fikes’s request for injunctive relief. The Sept. 25 hearing will address the parties in the case, but no substantive orders have been entered on that request as of the latest setting.
